Can the City enforce Home Owner’s Association by-laws, subdivision restrictions or deed restrictions (CC&R’s)?
No. If someone in the subdivision is violating a provision of the CC&R’s, it is the responsibility of the association to initiate legal enforcement action. The only regulations the code compliance and community relations can enforce are federal, state, and local laws and ordinances.
